Polyfab Education Promotion
Terms and Conditions

  1. This is a competition open to all Australian customers of Polyfab and/or The Nolan Group who have used a Polyfab product in a project at an Australian Primary School during the promotion period.
  2. Information on how to enter this Competition and the prizes form part of these Terms and Conditions.
  3. Participation in this Competition is deemed acceptance of these Terms and Conditions.
  4. This competition commences on Monday, 11 October at 09:00 AEDST and closes Friday 29th April 2022. 
  5. Entry is open to all businesses who have used a Polyfab shade product in a project at a Primary School located within Australia during the promotional period. (Eligible Business).
  6. Employees (and their immediate families) of The Nolan Group (ABN 28 135 927 249) and Polyfab Australia (ABN 28 135 927 249) are ineligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse child or step-child (whether natural or by adoption), parent, step-parent.
  7. For an Eligible Business to enter, an authorised representative (aged 18 years or over) must use the online competition form http://polyfab.com.au/competition
  8. An eligible business will receive one (1) entry each time they complete the entry form and include a project photo. Only one (1) entry per project location (Primary School) will be accepted. Eligible businesses can enter as many project locations (Primary Schools) as they would like during the promotional period.
  9. As condition of entering the Eligible Business consents to The Promoter using the Eligible Business’s details, the project location and the project photo in any media for an unlimited period without remuneration for the purpose of promoting Polyfab’s products.
  10. The promoter reserves the right, at any time, to verify the validity of entries, authorised representatives and Eligible Businesses and reserves the right, in its sole discretion, to disqualify any individual or Eligible Business who the Promoter had reason to believe has breached the Terms and Conditions.
  11. The random electronic draw will take place at 11:00am AEDST on Friday 29th April 2022.  at The Nolan Group Melbourne Office, 7 Conifer Close Dingley Village VIC. The promoter may draw additional reserve entries and record them in order in case an invalid entry is drawn. The owner of the Eligible Business and the Principal of the corresponding Primary School will be notified in writing and by telephone within two (2) business days of the draw taking place and published online http://polyfab.com.au/competition from Friday 29th April 2022. 
  12. The 2 x $500 prizes will be awarded to the owner/s of the winning Eligible Businesses. The 2 x $1000 prizes will be awarded to the Principal from the Eligible Businesses project location, Primary School.
  13. The first (1st) valid entry drawn will win a $500 VISA gift card (awarded to the Eligible Business) and $1000 VISA gift card (awarded to the Primary School where the project was completed).
  14. The second (2nd) valid entry drawn will win a $500 VISA gift card (awarded to the Eligible Business) and $1000 VISA gift card (awarded to the Primary School where the project was completed).
  15. The Promoter’s decision is final and no correspondence will be entered into.
  16. The total price pool value is $3000 including GST.
  17. As condition of accepting the price, the winner consents to The Promoter using the winning Eligible Business’s details and their name, and project photos in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome).
  18. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to pandemic, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) subject to any directions from a regulatory authority, extend, suspend, terminate or cancel the Promotion, as appropriate.
  19. Any cost associated with accessing the promotional website is the Eligible Business’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Business to automatically enter repeatedly is prohibited and will render all entries submitted on behalf of that Eligible Business invalid.
  20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business or authorised representative; or (f) taking/use of a prize.
  22. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act (Cth) 1988. A copy of the Promoter’s privacy policy can be viewed at https://www.nolans.com.au/privacy-policy/.
  23. This is a contest of chance as set out in these Terms and Conditions. All decisions are at the sole discretion of the Promoters and are final.
